Terms of Use

These terms are the agreement between you and us for using the Abacus Striker app. They cover who may hold an account, how the app may be used, what we are responsible for, and what happens when something goes wrong.

1. What these terms are

Bauddhik Aabhyas Edutech Private Limited ("we", "us") publishes and operates the Abacus Striker app. These terms apply to the app and to the games and services we run through it.

Creating an account or using the app means you accept these terms. If you do not accept them, please do not use the app. They bind you as the account holder, and they cover every Student Profile you create, because a Student Profile acts through you.

Our Privacy Policy is part of the same agreement. Where the terms shown in the app for a competition say something different, those terms govern that entry; these terms govern everything else.

2. Only adults hold accounts

You must be 18 or over to hold an account, and you must be the parent or legal guardian of the children you add, or act with their permission.

A child never holds an account. Children are Student Profiles, created and controlled by the account holder, with no password or login of their own. Every consent, payment, competition entry and request about data is made by the account holder.

You are responsible for what is done under your account, including what your child does in it. Keep your password and the one-time passwords we send you to yourself; we will never ask you for either. Tell us at once if you think someone else is using your account.

3. How the app may be used

The app is for the learning of the children on your own account, and for taking part in the games and competitions run through it.

Everyone who runs this service, including our staff, teachers, volunteers and directors, is entitled to be treated civilly, and so is every family using the app. You must not:

  • behave abusively, threateningly or obscenely, or in a harassing, defamatory or discriminatory way, towards any of them, whether in the app, by phone, by message or in person;
  • cheat in any game or competition, or help anyone else to cheat;
  • tamper with scores, points, ranks, results or certificates, or try to;
  • use an account that is not yours, or let anyone else use yours;
  • copy, scrape, record or circulate our questions, question papers or practice material;
  • photograph or publish images of our staff, our volunteers or other people's children without the permission of the people concerned; or
  • interfere with the app, its security or its servers, or try to reach data that is not yours.

We keep audit trails, access logs and records of support messages, and we may use them as evidence. If these rules are broken, we may restrict features, suspend or close the account, disqualify a competition entry, refuse future entries, report the matter to the police, and take any other action Indian law allows. We may keep the data needed to do so even after the account is closed.

4. Fair play

Every answer that decides a point, a rank or a prize is checked on our servers. A score reported by a phone, a tablet or a browser is never accepted on trust.

When those checks show something unusual, such as an answer time no child could achieve, a pattern that does not come from a person, or an account played from two places at once, we investigate. We may void an attempt, remove points or a rank, disqualify a competition entry, or hold a result back while we look into it. We tell the account holder what we found and why, and you can give your side to our Grievance Officer.

Ranks, age categories, serial numbers and certificate numbers are generated by the system and never typed in by hand. A published result is locked, and it changes only through the correction process in section 9.

5. Suspending or closing an account

We may restrict a feature, or suspend or close an account, if section 3 or 4 is broken, if an account is used to impersonate someone, if a payment is reversed dishonestly, or if the law or a court requires it. We tell you what we did and why, unless that would defeat an investigation or the law forbids it. For a minor breach, we restrict rather than close.

You can close your own account at any time. Delete Account in the app's account menu removes the account and every Student Profile under it after the wait you choose, and you can cancel it until the wait ends. Our Privacy Policy explains what we must keep afterwards.

6. What belongs to us

The questions, question papers, practice material, badge artwork, certificate designs, the app and its design, and the Abacus Striker name and logo belong to us or to those who licensed them to us.

You may use them for the learning of the children on your own account, and for nothing else. You may not copy, resell, publish, circulate, upload, translate or adapt them, use them to teach or coach anyone else, or let anyone else do any of those things. Please do not photograph, screenshot or share question papers or practice material in groups: doing so harms every child who sits the same paper later.

A certificate issued in your child's name is yours to keep, show and share.

7. Playing in the app is free

Practice, Games, Class Battles and 1v1 Races in the app are free.

No game in the app can be entered by paying a stake. There is no wager, no pot and no cash prize, and there is no way to pay money to play, to keep playing or to improve a result.

Where a competition has an entry fee, it is shown in the app before you register. An entry fee unlocks nothing inside the app: no points, badges, rank, rating, level or advantage of any kind.

8. Nominating someone to act for you

The Digital Personal Data Protection Act, 2023 lets you nominate someone to exercise your rights over your data, and your children's data, if you die or become unable to act. This is how it works:

  • You may nominate one or more adults who have agreed to act.
  • Write to our Grievance Officer with each nominee's name, their relationship to you and their contact details, and the mobile number or email address registered on your account.
  • We confirm the nomination to you at your registered contact before we record it.
  • You can change or withdraw a nomination at any time in the same way. We follow the most recent instruction we have recorded.

Before a nominee can act, we may ask for proof that you have died or cannot act, and for proof of the nominee's identity. A nominee can then exercise the rights you had: ask for a summary of the data and how it is processed, have it corrected, completed or erased, withdraw a consent, and raise a grievance. A nominee cannot enter competitions or spend money on the account.

There is no nomination screen in the app. A nomination takes effect when we confirm to you that we have recorded it.

9. Mistakes, and how we put them right

We do make mistakes: a name spelled wrong on a certificate, or a mark entered against the wrong seat. When that happens, we correct the record through our recorded correction process, reissue whatever was wrong, and tell every family whose result changes. A published result never changes quietly, and results are always published.

Tell us as soon as you notice a mistake, and quote the seat number or serial number on the admit card so that we can find the record.

10. Limits of our responsibility

The app is provided for educational practice and competition. We work to keep it accurate and available, but we cannot promise uninterrupted service: it may be unavailable during maintenance or an upgrade, or when something outside our control goes wrong.

We are not responsible for loss caused by your own device, internet connection or power supply, or by your sharing your account details or a one-time password with someone else.

Nothing in these terms limits any liability that Indian law does not allow us to limit, or takes away a right you have as a consumer under the Consumer Protection Act, 2019.

11. Changes to these terms

Every version of these terms has a version number and an effective date, shown at the top of this page. When we make a material change, we tell you in the app, by email or both before it takes effect, and ask you to accept it.

If you decline, you may keep using the app under the version you last accepted where that is possible. Where it is not, you should stop using the app, and you may delete your account. Using the app after the effective date of a change you were told about counts as acceptance.

12. Governing law

These terms, and our Privacy, Refund and Shipping policies, are governed by Indian law. You and we submit to the exclusive jurisdiction of the District and Sessions Court at Solapur, Maharashtra 413001, India, for any legal matter arising from them.

This does not take away your rights as a consumer: under the Consumer Protection Act, 2019 you can file a consumer complaint where you live or work. We ask you to raise any matter with our Grievance Officer first.
